Andrew F. Kim and Rebecca J. Riley are trial lawyers focusing on general business and commercial disputes, including sports and entertainment litigation, and criminal defense. Combined, they have served as lead counsel in over 100 jury trials to verdict and have more than 60 years of experience practicing law. In 2019, they made the list of Top 50 Jury Commercial Litigation Verdicts in the United States, obtaining as co-lead counsel the 46th highest commercial litigation verdict in the United States (state and federal court) and the 3rd highest breach of fiduciary duty verdict in California in Brees v. Moradi.. In 2022, Kim obtained on behalf of non-profit AIDS Healthcare Foundation and against conglomerate CVS Health Corporation’s pharmacy benefit manager, Caremark, a judgment in the United States District Court of Arizona confirming an arbitration award they had previously obtained pertaining to Caremark’s Medicaid Part D direct and indirect remuneration (DIR) programs. The total amount of that judgment was over $24 million. Kim and Riley have wide ranging experience representing and protecting companies, high net worth individuals, celebrities, and athletes in all aspects of their business and personal lives.


They counsel clients in all phases of pre-litigation and litigation with extensive experience in large, complex business disputes as well as day to day business and personal issues.  In addition to litigating in state and federal courts throughout California, they have conducted arbitrations before a multitude tribunals including the National Football League Players Association (NFLPA),  major arbital organizations, entertainment industry guilds (e.g. WGA, SAG, DGA), various entertainment trade organizations (e.g. IFTA) and the California Labor Commissioner.

 

Kim and Riley have represented companies and individuals (defendants and plaintiffs) engaged in a wide array of business pursuits, including professional athletes, sports agents, banks, manufacturers, wholesalers, distributors, designers, retailers, shipping companies, lenders, borrowers, investors, entrepreneurs, venture capitalists, realtors, physicians, health care clinics, consumers and non-profit organizations. In the entertainment context, Kim has represented production companies, television networks, producers, “show runners,” domestic and international distributors and sales agents, directors, writers, actors, singers, composers, talent agents and talent and business managers, among many others.

 

Kim Riley has extensive experience developing and administering international anti-piracy enforcement programs for intellectual property rights holders such as apparel manufacturers. Kim has obtained highly favorable settlements and multimillion dollar judgments in multiple jurisdictions against Internet-based and “brick and mortar” trademark counterfeiters, gray goods marketers and copyright infringers. Kim Riley also has extensive experience in accounting, vertical integration suits, defamation actions, restraining orders, rights of privacy, profit participation and other accounting disputes, intellectual property matters – such as misappropriation of trademark, copyright, idea submission, Lanham Act, and credit claims.

 

Additional representative matters include breach of contract, breach of fiduciary duty, fraud, business torts, extortion, “revenge porn,” federal and state unfair competition and actions pertaining to alleged governmental abuse of power.  Kim Riley has also protected clients and helped them achieve their aims in numerous private matters and achieved recovery of more than $50 million in verdicts and settlements.

In 2022, they obtained on behalf of non-profit AIDS Healthcare Foundation and against conglomerate CVS Health Corporation’s pharmacy benefit manager, Caremark, a judgment in the United States District Court of Arizona confirming an arbitration award they had previously obtained pertaining to Caremark’s Medicaid Part D direct and indirect remuneration (DIR) programs. The total amount of that judgment was $24,345,313.66 plus post-judgment interest at the daily rate of over $1,900 until paid.
